Food Delivery Aftermath – Short story on blue-collar worker & PoSH Law
11 in the night, the food delivery guy who had delivered my dinner an hour ago, texted me- “Hi Nair madam, sorry jaldi me tha, bol nahi paya k you are so hot. Abhi free hua hu, aa jaun kya?”
Yes! This is the man who knew my address and had somehow managed to get my phone number. I was scared because I live alone. I double-checked all the windows and door locks of my apartment. Fortunately, nothing happened that night.
I was unsure if the police would address this matter as it was “just” a message. But, I wanted to take action because the idea of what could have happened and what could happen in the future haunted me. I called my friend who works at Rainmaker, and she told me that such inappropriate messaging is considered Sexual Harassment under the PoSH Act, 2013 and that the delivery man, even though a blue-collar and gig worker, is considered an employee and is covered under the PoSH Act. Therefore, he is subjected to his Company’s PoSH Policy.
I immediately contacted the Food Delivery Agency through whom I had ordered food and reported this delivery man and his conduct. Their Internal Committee assisted me with all the details I needed to file a written complaint against this employee.
Strict action was taken against this delivery man after the Internal Committee of his Company conducted an inquiry & found him guilty of the offense of Sexual Harassment under the PoSH Act, 2013.
